State Attorney’s Office
- For the first time, the Public Attorney’s Office was established as an institution. According to the provisions of the Law on the Public Attorney’s Office from 1955, the Public Attorney’s Office represents before the courts and other state authorities the Federal People’s Republic of Yugoslavia, the people’s republics, autonomous units, regions and municipalities, institutions that have the status of a legal entity, in terms of property rights and obligations. , and are financed from the Budget, as well as the Funds established by the state authorities, and it has the capacity of a legal entity and performs other rights and duties determined by law. By the law passed on 01.01.1998, the Public Prosecutor’s Office is established as a service of the Government of the Republic Macedonia, which takes the measures and legal means determined by the Law for the purpose of legal protection of the property rights and interests of the Republic of Macedonia and exercises other rights determined by the Law. The function of the State Attorney’s Office is performed by the State Attorney of the Republic of Macedonia and the State Attorneys in the State Attorney’s Office. The State Ombudsman is appointed by the Government of the Republic of Macedonia on the proposal of the Ministry of Justice for a period of 6 years with the right to re-election.
- According to the provisions of the Law on the State Attorney’s Office of the Republic of Macedonia (hereinafter: the State Attorney’s Office) is a state body that takes measures and legal means for the purpose of legal protection of the property rights and interests of the Republic of North Macedonia and performs other tasks established by this and other Laws. The State Attorney’s Office exercises its powers based on the Constitution, the Law and ratified international agreements.
- The function of the State Attorney’s Office is performed by the State Attorney of the Republic of North Macedonia (hereinafter: the State Attorney) and the State Attorneys in the State Attorney’s Office (hereinafter: the State Attorneys).
- The State Ombudsman is appointed by the Government of the Republic of North Macedonia on the proposal of the Ministry of Justice for a period of 6 years with the right to re-election. State ombudsmen are appointed by the Government of the Republic of North Macedonia based on a previously obtained opinion from the State ombudsman without term limits.
- The Government of the Republic of North Macedonia, on the proposal of the State Ombudsman, determines with a Decision the number of State Ombudsman and adopts a Decision which determines the seat of the State Ombudsman and the areas of the courts where the State Ombudsman function is performed.
